When you access, browse or use this Site you accept, without limitation or qualification, the terms and conditions set forth below. The word ‘BOOKING’ with respect to our services mean “Activation of itinerary on the mobile app’. All information given in the website is based on the information available at the time of updation of the website. We reserve the right to change any website information before or after your booking the tour due to any events beyond our control. Incase if we are aware of any changes sufficiently in advance we will notify you at the time of itinerary creation, otherwise our Tour Handler will inform you of the changes. Major road works or floods, landslides may necessitate route changes in the itineraries, the restaurants may close or change management. All of these may cause you to make changes in the itineraries of your customers. Where we may know of these sufficiently in advance we will notify you to best of our efforts, however the primary responsiblity of such changes will lie you you or your Tour handler to inform your customer about those changes.
We are travel and holiday experience enhancers only. We do not control or operate any airline, neither do we own or control any shipping company, coach or coach company, Hotel, Transport, travel agents or their respective suppliers or any other facility or service mentioned on the website. We take care in selecting all the ingredients in your holiday; but because we only select and inspect them and have no control in running of them, we cannot be responsible for mechanical fault or any injury, death, loss or damage which is caused by the act or default of the management or employees of any hoteliers, airlines, shipping company, coach owner/ Transport operator who are the company’s independent contractors arising outside our normal selection and inspection process.
Site and Its Contents
This Site is only for your business use. As long as you comply with the terms of these Terms and Conditions of Use, Travelexic grants you a non-exclusive, non-transferable, limited right to enter, view and use this Site. You agree not to interrupt or attempt to interrupt the operation of this Site in any way.
Access to this Site is available to registered members. To become a registered member, you may be required to answer certain questions. Answers to such questions may be mandatory and/or optional. You represent and warrant that all information you supply to us, about yourself, and others, is true and accurate.
Others rights
If this Site contains bulletin boards, chat rooms, access to mailing lists or other message or communication facilities, you agree to use the same only to send and receive messages and materials that are proper and related thereto. By way of example and not as a limitation, you agree that when using the Site or any facility available herefrom, you shall not do any of the following:

- Advertise or offer to sell any goods or services, or conduct or forward surveys, contests or chain letters, or download any file posted by another user of a Forum that the User knows, or reasonably should know, cannot be legally distributed in such manner.
User’s Material
Travelexic is only a platform to transmit your information to the intended user in a specific form.
You are prohibited from posting or transmitting any defamatory, libelous, obscene, pornographic, profane, threatening or unlawful material or any material that could constitute or encourage conduct that would be considered a criminal offense or give rise to civil liability, or otherwise violate any law.
Travelexic assumes no liability or responsibility arising from the contents of any communications containing any defamatory, erroneous, inaccurate, libelous, obscene or profane material. Travelexic may change, edit, or remove any user material or conversations that are illegal, indecent, obscene or offensive, or that violates Travelexic’s policies in any way.
Travelexic will fully cooperate with any law enforcement authorities or court order requesting or directing Travelexic to disclose the identity of anyone posting such materials.
Transmitted Material
Internet transmissions are never completely private or secure. You understand that any message or information you send through this Site may be read or intercepted by others unless there is a special notice that a particular message (for example, credit card information) is encrypted (send in code). Sending a message to Travelexic does not cause Travelexic to have any special responsibility to you.
If due to interruptions or any other fault of the internet services at your end or the customer end, some or all of the information transmitted, is corrupted or is undelivered, Travelexic will not be responsible for any consequences thereof. You specifically indemnify Travelexic towards any liability created in such an event.
The copyright in the contents of this website belong to Travelexic. Accordingly Travelexic reserves all rights. Copying of part or all the contents of this website without permission of Travelexic is prohibited except to the extent that such copying/printing is necessary for the purposes of availing of the services provided.
Agency Terms and Conditions
1) There is no Contract between the company and the B2B or B2C agent until the company has received the initial app deposit amount per person itinerary created as specified. The full payment must be received in accordance with procedures laid down under Payments Terms. If not paid in that time, the company reserves the right to cancel the booking with consequent loss of deposit and apply scale of cancellation charges as mentioned in the cancellation policy hereunder.
2) The Company has the right at any time and for any reason:
a) To terminate the Contract after acceptance of the deposit but prior to the Commencement of Tour without assigning any reason whatsoever. In the event, the Company terminates the Contract; the company shall refund the initial deposit amount without payment of any interest.
b) To amend, alter, vary or withdraw any tour, holiday, excursion or facility it has advertised or published or to substitute an Independent Contractor of similar class if it is deemed advisable or necessary. In either case, the Company shall not be liable for any damage, additional expense, or consequential loss suffered by the Clients or for any compensation claims made.
c) It is clear understanding between either parties that any loss arising on account of cancellation of flight / train / bus tickets booked by the Clients; either through the Company or on his/her own or through a third party; the Company shall not be liable for such losses or additional expense, or consequential loss suffered by the Clients.
3) No person other than the Company, in writing, has the authority to vary, add, amplify or waive any stipulation, representation, term or condition in this brochure.
4) In the event of the Company exercising its rights to amend or alter any of the services as mentioned in the itinerary, after such tour or holiday has been booked, the Agent / Suppier shall have the right:
a) To continue with the services as amended or altered.
b) To accept any alternative service which the company may offer.
In either of these above cases the Agent/Supplier shall not be entitled to, or the Company shall not be liable to the End Customer / Agent or Supplier or any other party for any damage. Additional expense, consequential loss suffered by him or to pay any amount as refund.
5) In case of any dispute, decision of Travelexic will be final and binding.
6) Payment due to Travelexic will be credited on a weekly basis. Every Tuesday of the week or as per the Collection period notified by Travelexic from time to time.
7) TDS will be deducted as per the law. TDS will be deducted on all commissions/incentives. The TDS certificate will be issued in the next Financial Year.
Privacy
Travelexic adopts appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.
Travelexic does not sell, trade, or rent personal information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding customers and users with our business partners, trusted affiliates and advertisers for variety of purposes.
Health & Safety:
The Company shall in no circumstances whatsoever will be liable to the Client or any person traveling for:
a) Any death personal injury, sickness, accident, loss, delay, discomfort, increased expenses, consequential loss and / or damage or any misadventure howsoever caused
b) Any act, omission, default or Independent Contractor or other person or be any servant or agent , employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facilities or service for the Client or for any person travelling with him howsoever caused.
c) The temporary or permanent loss of or damage to baggage or personal effects howsoever caused In this condition the expression “Howsoever caused” includes negligence on the part of any person.
6) No liability on the part of the Company arising in any way out of this Contract in respect of any tour, holiday, excursion facility shall not exceed the total amount paid or agreed to be paid for the itinerary creation, and shall in no case include any consequential loss or additional expense whatsoever.
Disclaimer
The material in this Site could include technical inaccuracies or typographical errors. Travelexic may make changes or improvements at any time.
Travelexic does not warrant that the functions contained in this site will be uninterrupted or error free, that defects will be corrected, or that this site or the servers that make it available are free of viruses or other harmful components, but shall endeavour to ensure your fullest satisfaction.
Travelexic does not warrant or make any representations regarding the use of or the result of the use of the material on the site in terms of their correctness, accuracy, reliability, or otherwise, insofar as such material is derived from other service providers such as hotel owners activity providers and yourself
You acknowledge that this Website is provided only on the basis set out in these terms and conditions. Your uninterrupted access or use of this Website on this basis may be prevented by certain factors outside our reasonable control including, without limitation, the unavailability, inoperability or interruption of the Internet or other telecommunications services or as a result of any maintenance or other service work carried out on this Website. Travelexic does not accept any responsibility and will not be liable for any loss or damage whatsoever arising out of or in connection with any ability/inability to access or to use the Site.
You also acknowledge that through this Site, Travelexic merely provides intermediary services in order to facilitate highest quality services to you and your customers. Travelexic is not the last-mile service provider to you and therefore, Travelexic shall not be or deemed to be responsible for any lack or deficiency of services provided by any person (airline, travel/tour operator, hotel, facility or similar agency) you shall engage or hire or appoint for your customers.
Travelexic will not be liable to you or to any other person for any direct, indirect, incidental, punitive or consequential loss, damage, cost or expense of any kind whatsoever and howsoever caused from out of your usage of this Site.
Terms and Conditions of Use
Travelexic may add to, change or remove any part of these Terms and Conditions of Use at any time, without notice. Any changes to these Terms and Conditions of Use or any terms posted on this Site apply as soon as they are posted. By continuing to use this Site after any changes are posted, you are indicating your acceptance of those changes.
Travelexic may add, change, discontinue, remove or suspend any features and specifications of described or depicted on the Site, temporarily or permanently, at any time, without notice and without liability.
Travelexic reserves the right to undertake all necessary steps to ensure that the security, safety and integrity of Travelexic’s systems as well as its clients’ interests are and remain, well-protected. Towards this end, the Company may take various steps to verify and confirm the authenticity, enforceability and validity of orders placed by you.
General Provisions
Travelexic reserves its right to deny in its sole discretion any user access to this Site or any portion hereof without notice.
No waiver by Travelexic of any provision of these Terms and Conditions shall be binding except as set forth in writing and signed by its duly authorized representative.
If any dispute arises between you and Travelexic during your use of the Site or thereafter, in connection with and arising from your use or attempt to use this Site, the dispute shall be referred to arbitration. The place of arbitration shall be Alwar. The arbitration proceedings shall be in the English language.
The said arbitration proceedings shall be governed and construed in accordance with the Arbitration and Conciliation Act, 1996 and modifications thereof as in force at the relevant time.
These terms and conditions are governed by and shall be construed in accordance with the laws of the Republic of India and any dispute shall exclusively be subject to the jurisdiction of the appropriate Courts situated at Alwar, Rajasthan, India.
‘We take care in ensuring all the itinerary information provided to us by your the supplier or travel agent is passed on to their customer’s seamlessly and the same information is enriched with Travelexic extras of enroute info, etc.’
